Parker Brown Macaulay & Sheerin, a boutique law firm focused solely on ERISA and employee benefits, seeks an ERISA and employee benefits attorney to join our team as an associate. The position is fully remote and may be either a part-time or full-time position.
Your role will be to support the firm’s partners and clients on ERISA and employee benefits matters. You will provide counsel on plan design, plan administration and correction, and statutory and regulatory compliance of employee benefit plans. The position will primarily be focused on tax-qualified retirement plans (defined benefit, 401(k) and other defined contribution plans and 403(b) plans) and also non-qualified executive deferred compensation plans, including 457(b) and 457(f) plans. However, the ideal candidate will have knowledge and experience in all types of employee benefit plans, including health and welfare plans and non-ERISA plans.
Key Responsibilities:
Plan Design and Drafting:?Drafting and reviewing plan documents, amendments, summaries, policies, and procedures for employee benefit and executive compensation plans. ?
Regulatory Compliance and Advice: ?Ensuring plans comply with applicable statutes, regulations, and guidance relating to employee benefit and executive compensation plans, including ERISA, the Internal Revenue Code, Section 409A, and the Affordable Care Act (ACA). ?
Fiduciary Responsibility:?Advising on fiduciary duties and responsibilities related to plan administration and assisting fiduciaries with meeting those duties and responsibilities. ?
Corrections and Audits:?Assessing issues and failures, devising solutions, and assisting with implementing plan corrections, including under IRS and DOL correction programs and conducting compliance audits. ?
Employee Benefits Strategy:?Helping employers develop and manage their overall benefits strategy and advising business owners of the impact of employee benefit laws on business decisions. ?
Required Skills and Experience:
Juris Doctor degree: from an ABA-accredited law school.
Active license to practice law in good standing.
Excellent analytical, research, and communication skills.
Ability to work independently and as part of a team.
Desired Skills and Experience:
5+ years of experience with tax-qualified retirement plans with another law firm, a consulting firm, a plan custodian, or a government agency.
Strong understanding of ERISA, the Internal Revenue Code, and other relevant laws.
Experience with plan design, drafting, and implementation.
Experience with compliance audits and correction programs.
Experience with qualified and non-qualified retirement plans, health and welfare plans, and executive compensation arrangements is a plus.
